第889条 有关通讯和视频监控设备或服务的禁令

《国防授权法案》第889条要求联邦政府机构不得采购或获取任何使用“受控的通信设备或服务”(作为系统关键或实质性的一部分,或作为系统的任一部分关键的技术的设备、系统或服务)。
其中,“受控的通信设备或服务”包括
- 华为技术公司或中兴通讯公司(或其子公司或附属公司)生产的通讯设备;
- 海能达通信公司、杭州海康威视数字技术公司或大华技术公司(或此类实体的任何子公司或关联公司)的监控和通信设备。
- 由上述公司提供的或使用了他们的设备的电信或视频监控服务。
以下为第889条法令原文:
- 使用或采购禁令。—
(1) 行政机构负责人不得—
(A) 采购、获取、扩展或更新合同,以采购或获取任何将(f)(3)条款所指的通讯设备或服务作为重要或基本组成部分的,或作为系统的任一部分关键技术的设备、系统或服务;或
(B) 与任何使用了将(f)(3)条款所指的通讯设备或服务作为重要或基本组成部分的,或作为系统的任一部分关键技术的设备、系统或服务的实体签订合同(或延长或续签合同)。
(2) 第(1)条不得解释为—
(A) 禁止行政机构负责人向任一实体购买能够连接到第三方设施的服务,如回程通信、漫游或互连通信;或
(B) 囊括不能发送或重新定向用户数据流量,或者传输的或以其他方式处理的任何用户数据或数据包被允许可见的电信设备。
(b) 贷款和拨款禁令。—
(1) 行政机构负责人不得发放贷款或拨款以采购或者获取、延长或更新合同以获取或签订合同(或延长更新合同)以获取在(a)小节中所述设备、服务或系统。
(2) 在执行第(1)款中的禁令时,管理贷款、拨款或补贴计划的行政机构负责人,包括联邦通信委员会、农业部、国土安全部、小企业管理署和商务部应优先考虑将可供使用的资金和技术支持用以支持受影响的企业、机构和组织,在合理和必要的情况下,帮助这些受影响的实体从(f)(3)所指的通信设备和服务过渡到可供替换的设备和服务,并且确保向用户和客户提供的通信服务是可持续的。
(3) 本款不得解释为-
(A) 禁止行政机构负责人向任一实体购买能够连接到第三方的服务,如回程通信、漫游或互连通信;或
(B) 囊括不能追踪或不能重新定向用户数据的电信设备,或者传输的或以其他方式处理的任何用户数据或数据包被允许可见的电信设备。
(c)生效日期—第(a)(1)(A)款下的禁令应自本法通过之日起一年后生效,第(a)(1)(B)款和第(b)(1)款下的禁令应自本法通过之日起两年后生效。
(d) 豁免方
(1)行政机构。—行政机构的负责人可以一次性地豁免(a)小节中的对请求豁免的实体的规定。在(c)小节所述的生效日期后不超过两年的时间内,被豁免的行政机构可以被提供服务,只要寻求豁免的实体-
(A) 能够向行政机构负责人提供令人信服的理由并确定需要额外时间来执行该小节下的要求;以及
(B) 向行政机构负责人提交一份全面、完整的(f)(3)所指的通信或视频监控设备或服务在该实体的供应链中的现状报告和逐步淘汰计划,以从该实体系统中消除此类(f)(3)所指的电信或视频监控设备或服务。行政机构负责人应在不迟于30天后向相关的国会委员会(见(f)(1))提交该报告。
(2) 国家情报总监。—如果国家情报总监认为豁免符合美国国家安全利益,国家情报总监可在(c)小节所述的生效日期之后提供豁免。
(f) 释义-在本节中:
(1) 相关的国会委员会-术语“相关的国会委员会”是指-
(A) 银行、住房和城市事务委员会、外交关系委员会和参议院国土安全和政府事务委员会;以及
(B) 金融服务委员会、外交事务委员会和众议院监督和政府改革委员会。
(2) 涵盖的外国-术语“covered foreign country”是指中华人民共和国。
(3) 涵盖的通讯设备或服务-术语“涵盖的电信设备或服务”指以下任何一种:
(A) 华为技术公司或中兴通讯公司(或其子公司或附属公司)生产的通讯设备。
(B) 为了公共安全、政府设施的安全、重要基础设施的物理安全监控以及其他国家安全目的,由海能达通信公司、杭州海康威视数字技术公司或大华技术公司的监控和通信设备公司(或此类实体的任何子公司或关联公司)生产提供的视频监控与通讯设备。
(C) 由该诸实体提供或使用该诸设备的通信或视频监控服务。
(D) 国防部长在与国家情报总监或联邦调查局局长协商后,有理由认为是由中华人民共和国政府拥有、控制或与其有关联的实体所生产或提供的通信或视频监控设备或服务。
(4) 行政机构-术语“行政机构”的含义在美国法典第133节44条中。
SEC. 889. PROHIBITION ON CERTAIN TELECOMMUNICATIONS AND
VIDEO SURVEILLANCE SERVICES OR EQUIPMENT.
- PROHIBITION ON USE OR PROCUREMENT. —(1) The head of an executive agency may not—
(A) procure or obtain or extend or renew a contract to procure or obtain any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system; or
(B) enter into a contract (or extend or renew a contract)with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system.
(2) Nothing in paragraph (1) shall be construed to—
(A) prohibit the head of an executive agency from procuring with an entity to provide aservice that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(B) cover telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(b) PROHIBITION ON LOAN AND GRANT FUNDS.
(1) The head of an executive agency may not obligate or expend loan or grant funds to procure or obtain, extend or renew a contract to procure or obtain, or enter into a contract (or extend or renew a contract) to procure or obtain the equipment, services, or systems described
in subsection (a).
(2) In implementing the prohibition in paragraph (1), heads of executive agencies administering loan, grant, or subsidy programs, including the heads of the Federal Communications Commission, the Department of Agriculture, the Department of Homeland
Security, the Small Business Administration, and the Department of Commerce, shall prioritize available funding and technical support to assist affected businesses, institutions and organizations as is reasonably necessary for those affected entities to transition from covered communications equipment and services, to procure replacement equipment and services, and to ensure that communications service to users and customers is sustained.
(3) Nothing in this subsection shall be construed to—
(A) prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(B) cover telecommunications equipment that cannot route
or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c)EFFECTIVE DATES.—The prohibition under subsection(a)(1)(A) shall take effect one year after the date of the enactment of this Act, and the prohibitions under subsections (a)(1)(B) and(b)(1) shall take effect two years after the date of the enactment of this Act.
(d) WAIVER AUTHORITY.—
(1) EXECUTIVE AGENCIES.—The head of an executive agency may, on a one-time basis, waive the requirements under subsection(a) with respect to an entity that requests such a waiver. The waiver may be provided, for a period of not more than two years after the effective dates described in subsection (c), if the entity seeking the waiver—
(A) provides a compelling justification for the additional time to implement the requirements under such subsection, as determined by the head of the executive agency; and
(B) submits to the head of the executive agency, who shall not later than 30 days thereafter submit to the appropriate congressional committees, a full and complete
laydown of the presences of covered telecommunications or video surveillance equipment or services in the entity’s supply chain and a phase-out plan to eliminate such covered
telecommunications or video surveillance equipment or services from the entity’s systems.
(2) DIRECTOR OF NATIONAL INTELLIGENCE.—The Director of National Intelligence may provide a waiver on a date later than the effective dates described in subsection (c) if the Director determines the waiver is in the national security interests of the United States.
(f) DEFINITIONS.—In this section:
(1) APPROPRIATE CONGRESSIONAL COMMITTEES.—The term ‘‘appropriate congressional committees’ ’’ means—
(A) the Committee on Banking, Housing, and Urban Affairs, the Committee on Foreign Relations, and the Committee on Homeland Security and Governmental Affairs
of the Senate; and
(B) the Committee on Financial Services, the Committee on Foreign Affairs, and the Committee on Oversight and Government Reform of the House of Representatives.
(2) COVERED FOREIGN COUNTRY.—The term ‘‘covered foreign
country’’ means the People’s Republic of China.
(3) COVERED TELECOMMUNICATIONS EQUIPMENT OR SERVICES.—
The term ‘‘covered telecommunications equipment or services’’ means any of the following:
(A) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities).
(B) For the purpose of public safety, security of government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video
surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology
Company (or any subsidiary or affiliate of such entities).
(C) Telecommunications or video surveillance services provided by such entities or using such equipment.
(D) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director
of the National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
(4) EXECUTIVE AGENCY.—The term ‘‘executive agency’’ has the meaning given the term in section 133 of title 41, United States Code.
